People are waiving pride flags.\" class=\"wp-image-354\" srcset=\"https:\/\/blog.utc.edu\/app\/uploads\/sites\/167\/2026\/04\/pride1-1024x881.jpg 1024w, https:\/\/blog.utc.edu\/app\/uploads\/sites\/167\/2026\/04\/pride1-768x661.jpg 768w, https:\/\/blog.utc.edu\/app\/uploads\/sites\/167\/2026\/04\/pride1-580x499.jpg 580w, https:\/\/blog.utc.edu\/app\/uploads\/sites\/167\/2026\/04\/pride1-610x525.jpg 610w, https:\/\/blog.utc.edu\/app\/uploads\/sites\/167\/2026\/04\/pride1.jpg 1440w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">Pride Parade in Downtown Chattanooga, Oct. 2025 Photo Credit: Seed Theater<\/figcaption><\/figure>\n\n\n\n<p><strong>NASHVILLE, TENN. &#8211; The Tennessee General Assembly passed <a href=\"https:\/\/wapp.capitol.tn.gov\/apps\/BillInfo\/Default?BillNumber=SB2031\">SB2031\/HB1872<\/a> in April, legislation allowing healthcare professionals to be sued for coercing patients into seeking gender-affirming care up to 30 years after treatment. <\/strong><\/p>\n\n\n\n<p>The bill is now on Governor Bill Lee\u2019s desk awaiting his signature or veto.<\/p>\n\n\n\n<p>The bill defines coercion as \u201ca threat, however communicated, to commit an offense; wrongfully accuse a person of an offense; expose a person to hatred, contempt or ridicule; harm the credit or business repute of a person; or take or withhold action as a public servant or cause a public servant to take or withhold action.\u201d<\/p>\n\n\n\n<p>The Senate sponsor, Sen. Adam Lowe R-Calhoun, said he introduced the legislation because the Senate received testimony from people who experienced personal injuries related to gender reassignment treatment. These people, he said, are entitled to seek damages under premises of malpractice, but it is often difficult for them to do so.&nbsp;<\/p>\n\n\n\n<p>\u201cCreating a private ride of action further establishes their rights to challenge whether or not the treatment they received was in their best interest or a matter of providers super imposing their politics on care,\u201d Lowe said. \u201cWellness should lead to independence, longevity, and contentment and there is growing evidence that gender altering care does not create that wellness.\u201d<\/p>\n\n\n\n<p>Lowe described a few cases where former patients said they were coerced into surgery. <\/p>\n\n\n\n<p>However, according to a <a href=\"https:\/\/transequality.org\/sites\/default\/files\/2025-06\/USTS_2022Health%26WellbeingReport_WEB.pdf\">2022 survey by the National Center for Transgender Equality,<\/a> only 9% of respondents decided to \u201cde-transition.\u201d Of those who de-transitioned, less than 1% realized gender transitioning didn\u2019t suit them. Others cited either pressure from family and society or facing harassment and discrimination as their reasons for de-transitioning.<\/p>\n\n\n\n<p>Rep. Jason Zachary R-Knoxville, the bill\u2019s House sponsor, made the argument on the House floor that his bill does not harm those who are happy with their gender reassignment treatment, but instead helps those who were \u201ccoerced.\u201d Similarly, Rep. Greg Martin R-Hixson said he voted in favor of the bill to protect Tennesseans.<\/p>\n\n\n\n<p>\u201cMedical professionals should never coerce Tennesseans into life-altering gender transition procedures with permanent consequences,\u201d Martin said. \u201cHouse Bill 1872 is a common-sense proposal that protects those who have been harmed and ensures they have a clear path to seek accountability and justice.\u201d<\/p>\n\n\n\n<p>Democratic lawmakers, such as Sen. Heidi Campbell D-Nashville, voted against Lowe and Zachary\u2019s bill out of concern for both patients and medical providers. She said the bill creates a subjective standard of coercion that could undermine clinical judgment and cause providers who are acting in good faith to fear litigation.<\/p>\n\n\n\n<p>\u201cHealthcare decisions, especially those involving gender-affirming care, are deeply personal and should be guided by evidence-based medical standards and the trusted relationship between a patient and their provider,\u201d Campbell said. \u201cLegislation that introduces legal ambiguity into that relationship risks discouraging providers from offering care altogether, which can limit access and negatively affect patient outcomes.\u201d<\/p>\n\n\n\n<div class=\"wp-block-jetpack-slideshow aligncenter\" data-autoplay=\"true\" data-delay=\"3\" data-effect=\"slide\"><div class=\"wp-block-jetpack-slideshow_container swiper\"><ul class=\"wp-block-jetpack-slideshow_swiper-wrapper swiper-wrapper\"><li class=\"wp-block-jetpack-slideshow_slide swiper-slide\"><figure><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" alt=\"Elizabeth Haley, executive director of Seed Theater, addressing the press, supporting queer kids' mental health in Hamilton County Schools, September 2025. She criticized the bill, calling it a \u201cwaste of our time and money as taxpayers.\u201d<\/p>\n\n\n\n<p>\u201cI work with hundreds of trans and gender nonconforming people in Tennessee on a regular basis,\u201d Haley said, \u201cand the last thing anybody wants to talk about is how their doctor went above and beyond talking them into this. That\u2019s not something that happens\u2026it\u2019s just a very complex process to proceed with gender-affirming surgery.\u201d<\/p>\n\n\n\n<p>Haley condemned the legislation.<\/p>\n\n\n\n<p>\u201cWhen cisgendered, heterosexual people make rules about something they know nothing about\u2026it\u2019s wasting our legislative session doing things that nobody cares about when they could be feeding children or fixing housing.\u201d<\/p>\n\n\n\n<p>Additionally, Haley responded to <a href=\"https:\/\/wapp.capitol.tn.gov\/apps\/BillInfo\/Default?BillNumber=HB0754&amp;ga=114\">SB0676\/HB0754<\/a> &#8211; a state bill passed by the General Assembly that requires gender clinics operating in the state to \u201creport statistics regarding all gender transition procedures to the department of health on a form provided by the department.\u201d The bill specifically requires gender clinics to report:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The state and county of residence of the person receiving the gender transition procedure.<\/li>\n\n\n\n<li>The name, contact information, and medical specialty of the healthcare professional who prescribed the gender transition procedure or made the referral for the gender transition procedure.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>\u201cIt is crucial that we don\u2019t collect people\u2019s personal data,\u201d Haley said. \u201cWe [Seed Theater] don\u2019t keep lists. We keep relationships. We have an idea of who and where and how to find people, but there is nowhere, in any of my documentation, be it encrypted or not, that we keep a list. We know what a list of transgender people could be used as: a weapon.\u201d<\/p>\n\n\n\n<p>The bill\u2019s Senate sponsor, Sen. Brent Taylor R-Memphis, said on the Senate floor it is a commonsense piece of legislation that just provides data and does not require identifying information to be reported.<\/p>\n\n\n\n<p>Haley expressed fears the bill compromises the safety of transgender people in Tennessee, comparing it to recent ICE deportations in the state.<\/p>\n\n\n\n<p>\u201cWe had lists of people in the country who were pursuing immigration status\u2026and when those people started showing up at their immigration appointments as scheduled\u2026those people were arrested by ICE and deported from the country, even though they were doing it right,\u201d Haley said. \u201cWhen we have such a direct comparison of what\u2019s happening right now &#8211; when our administration has made no attempts to hide the fact that they are coming for trans people\u2026there\u2019s nothing we can look at and say that\u2019s not what\u2019s happening.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NASHVILLE, TENN. &#8211; The Tennessee General Assembly passed SB2031\/HB1872 in April, legislation allowing healthcare professionals to be sued for coercing patients into seeking gender-affirming care up to 30 years after treatment.
